Jersey City is one of the most strictly regulated markets in the Northeast. The city has effectively banned the standard rental arbitrage model. Only property owners are eligible to apply for and hold short-term rental permits, meaning a tenant signing a lease cannot legally list a unit on Airbnb. Furthermore, the city strictly dictates where STRs can exist based on building size, preventing hosts from taking over large apartment complexes.

Key Requirements

  • Property Owners Only: You must be the legal owner of the property to get an STR permit. Tenants are strictly prohibited from operating short-term rentals.
  • The "4-Unit Rule" (Building Cap): Short-term rentals are banned entirely in buildings with more than four (4) units. In buildings with 4 or fewer units, an owner who lives on-site can only rent out up to two of the units.
  • The 60-Day Cap: If the property owner is not physically present on-site during the stay (unhosted stays), the property can only be rented for a maximum of 60 nights per calendar year.
  • Rent Control Ban: Short-term rentals are completely prohibited in rent-controlled and income-restricted units.

Operational and Safety Standards

  • Permit Required: You must first obtain a Zoning Determination Letter (ZDL) and then apply for a Short-Term Rental Permit ($250 initial fee, $200 annual renewal).
