Anaheim enforces one of the strictest bans in the country. Since the 2016 STR Ordinance, the city has stopped issuing new short-term rental permits entirely. Only the ~277 properties that were already permitted prior to 2016 ("Grandfathered" units) are allowed to operate, provided they renew annually. If you do not already have one of these golden permits, you cannot get one. Note: This ban applies to all residential zones (Single Family & Multi-Family). There is no "arbitrage loophole" here.
Key Requirements
- New Permits: None available. The application process is closed to new entrants.
- Minimum Stay: Even if you did have a grandfathered permit, you must enforce a minimum stay of 3 nights.
- Transferability: Permits are non-transferable. If a grandfathered home is sold, the permit dies. You cannot "buy" a permitted house to keep the Airbnb going.
Operational and Safety Standards
- N/A for New Operators: Since you cannot operate legally, these standards only apply to the few grandfathered hosts (e.g., 45-minute response time for complaints, strict noise curfews).
Tax Obligations
- TOT Rate: 15% Transient Occupancy Tax.
- Collection: Airbnb collects this for the few legal listings remaining.
Enforcement
- Platform Blocking: Airbnb and Vrbo have integrated with the City of Anaheim. They will block your listing if you do not enter a valid, verified permit number.
- Fines: Operating an unpermitted rental results in immediate citations, fines starting at $500+, and potential utility shutoffs.
- "Bounty Hunter" Apps: The city uses specialized software to scrape listings and identify illegal operators immediately.
