- The 60-Day Cap: If the property owner is not physically present on-site during the stay (unhosted stays), the property can only be rented for a maximum of 60 nights per calendar year.
- Rent Control Ban: Short-term rentals are completely prohibited in rent-controlled and income-restricted units.
Operational and Safety Standards
- Permit Required: You must first obtain a Zoning Determination Letter (ZDL) and then apply for a Short-Term Rental Permit ($250 initial fee, $200 annual renewal).
- Occupancy Limits: There is a strict hard cap of two (2) guests per bedroom, plus two (2) additional guests for the entire unit.
- Guest Age Restriction: STRs cannot be rented to anyone under the age of 21.
- Liability Insurance: You must provide proof of at least $500,000 in commercial general liability insurance to obtain your permit.
- Neighbor Notification: Hosts must officially notify adjacent property owners when applying for a permit, providing them with the 24/7 contact info of the designated "Responsible Party."
Tax Obligations
- Total Tax Rate: Taxes are very high here, cumulatively reaching over 20%. This includes:
- New Jersey Sales Tax (6.625%)
- State Occupancy Fee (5%)
- Jersey City Hotel Occupancy Tax (6%)
- Meadowlands Regional Hotel Use Assessment (3%)
- Registration: You must ensure you are registered with the NJ Division of Taxation.
