Salisbury has no short-term rental permit, cap or registration that we could find, but its zoning code doesn't list short-term rentals either.[1, 2] It defines Residential use to exclude rentals of less than a month, allows Lodging uses in only some districts, and presumes unlisted uses are prohibited.[2] On top of that you owe North Carolina sales tax and Rowan County's 6% room occupancy tax.[6, 7] Get the planning office's written answer for your address before you sign a lease.

Residential or lodging

The zoning code defines Residential as long-term human habitation and excludes rental of less than a month.[2] It defines Lodging as premises available for short-term human habitation, including daily and weekly rental.[2]

Unlisted uses

Uses the Use Matrix doesn't list are presumed prohibited in the district.[2] The Administrator decides whether a materially similar use exists and records the decision in writing.[2] Ask for that written decision for your address before you sign a lease.

Where lodging is allowed

The Use Matrix lists bed and breakfasts and hotels, motels and inns under Lodging.[2] It doesn't permit them in every district, and it permits hotels in fewer districts than bed and breakfasts.[2]

City license listing

The city's list of taxes includes a license for hotels, motels, tourist courts and similar places that advertise for transient guests, at $1.00 per room a year with a $25 minimum.[4] The listing doesn't say whether it covers a rented house, so ask the city before you assume it does or doesn't.

Operational and safety standards

Vacation rental agreement

North Carolina's Vacation Rental Act covers a landlord or real estate broker who rents or manages residential property for vacation rental, meaning a stay of fewer than 90 days by a guest who has a permanent residence to return to.[3] It requires a written vacation rental agreement that the guest accepts.[3] The act defines a landlord as an owner, so check whether your lease setup fits it.[3]

Guest money

If you require advance payments, deposit them in a trust account within three banking days.[3] No more than 50% of the total rent may be paid out before the guest arrives, apart from the act's listed exceptions, and tax funds and deposits stay in the account until the stay ends.[3]

Safety equipment

The landlord must provide operable smoke detectors and at least one carbon monoxide alarm per unit per level.[3] The landlord must also keep the property fit and habitable and follow applicable building and housing codes.[3]

Human trafficking steps

Before first listing a vacation rental, the property manager must set up a procedure for reporting suspected human trafficking.[3] The act also requires human trafficking awareness training for the people it lists.[3]

Removing a guest

For a stay of 30 days or less, the landlord or the broker acting for the landlord can use expedited eviction if the guest holds over, breaches the agreement, doesn't pay, or got possession by fraud.[3] The landlord or broker must first give at least four hours' notice to quit.[3]

Tax obligations

State sales tax

North Carolina taxes the gross receipts from renting an accommodation, which includes a residence or cottage, at the general state and applicable local and transit sales tax rates, plus any local occupancy tax.[7] Cleaning and pet fees count as part of those gross receipts.[7]

County sales tax rate

NCDOR's rate table lists Rowan County at 7%.[5] You file and pay the sales tax on Form E-500 through NCDOR's online system.[7]

Room occupancy tax

Rowan County's room occupancy tax form applies a six percent rate.[6] The county must receive the return, or it must be postmarked, by the 20th of the month after the tax accrues.[6] State law lets Rowan County levy up to 3% plus an additional tax of up to 3%.[8]

Late penalties

Filing late costs 5% of the tax for up to one month, with another 5% for each added month, up to 25%.[6] Paying late costs 5% of the tax, a penalty the form shows until July 1, 2027.[6]

Platforms and the city line

An accommodation facilitator has the same responsibility under the county room occupancy tax as it has under the state sales tax.[9] The city code's appendix still lists a 3% city room occupancy tax,[10] but the county form we found shows only its own rate, so confirm with Rowan County Finance before you file.[6]

Enforcement

Zoning citations

A zoning violation draws a $50 civil citation after a code officer notifies you and you don't correct it.[2] A second citation for an uncorrected violation is $100.[2] After another written notice, the penalty is $250 per day until you correct the violation.[2]

Complaints and appeals

Anyone can file a written complaint with the Administrator, who records it and investigates.[2] You can appeal a violation notice to the Zoning Board of Adjustment within 10 days of receiving the first notice.[2] Missing that window counts as accepting that a violation exists.[2]

Other remedies

The city can also pursue a misdemeanor charge, an injunction, an order of abatement or other equitable relief.[2] The owner, tenant or occupant, and anyone who helps create or maintain the violation, can face these penalties.[2]

Disorder program

Chapter 14, Article VI requires owners of residential rental property to register when excessive levels of disorder activity have occurred on or in the property.[11] The purpose section doesn't say whether it reaches short-term rentals.[11]

State bill watch

Senate Bill 291 of 2025, titled Regulation of Short-Term Rentals, was referred to the Senate Rules committee on Mar 17, 2025, and its history shows no later action.[12] A bill that hasn't passed changes nothing for you today.
